Ed Gonsalves and Nick Hallenbeck obtain DEFENSE VERDICT in the United States District Court for the District of Columbia. Plaintiff alleged that an internal medicine physician breached the standard of care by ordering a blood test routinely, rather than “STAT.” Plaintiff alleged that a “STAT” order would have led to treatment that would have prevented the patient’s cardiac event and permanent kidney failure. After a five-day trial, the jury found that the physician complied with the standard of care and exercised proper clinical judgment because the cardiac event and renal failure were not reasonably foreseeable based upon the patient’s clinical presentation.
