ADCVR attorneys, Andrew Marter and Gretchen Slater, recently obtained a defense verdict in favor of their physician client in a wrongful death and survival action filed in the Circuit Court of Maryland for Montgomery County. The plaintiffs alleged medical negligence. They argued that the physician, a cardiologist, inappropriately prescribed a medication for the patient’s atrial arrhythmia, and that the medication resulted in respiratory failure and death. The defense argued that the medication was safe and effective, and that it’s use for the arrhythmia in question was reasonable. After a six day trial, the jury concluded that, despite the unfortunate outcome, the physician’s care and treatment was appropriate and complied with the standard of care in all respects.
