ADCVR attorney, German A. Rodriguez, recently obtained a defense verdict in a veterinary medical negligence case in the District Court for Carroll County, Maryland. The Plaintiff alleged that a veterinarian did not provide appropriate care and management to a horse owned by the Plaintiff. The alleged occurrence took place while rendering veterinary care to the horse in the course of an animal neglect investigation by government officials due to the deteriorating condition of the horse. At trial, the Court granted the defense’s Motion for Judgment at the close of the Plaintiff’s case, holding that the Plaintiff failed to establish that the veterinarian breached any applicable standard of care or that any alleged breach was the proximate cause of the injuries alleged.
